DACC Immigration Compliance (HB1312 IL)
House Bill 1312 (HB 1312) is a new Illinois law that provides protection for students, employees, and visitors during civil immigration enforcement on campus. The following outlines steps for Danville Area Community College students, staff and faculty to follow if Immigration and Customs Enforcement (ICE) agents come to campus.
As a public community college, Danville Area Community College (DACC) welcomes the public to a significant portion of campus. However, access is restricted to certain parts of the campus due to confidentiality, safety, or operational needs. Federal Immigration Enforcement Officers are subject to these same restrictions and must adhere to these restrictions in non-public spaces.
Public space on DACC Campus is defined as an open area with no restrictions to the general public.
Non-public space on DACC Campus is defined as an area on campus that has limited or no access to the general public and in some instances certain employees depending on their roles on campus.
A valid judicial warrant is defined as a court order signed by a federal judge or magistrate authorizing entry, search, or arrest.
Immigration-enforcement officers are defined as Agents of Customs and Enforcement (ICE), the Department of Homeland and Security (DHS), Customs and Border Patrol (CBP), or any other federal agency engaged in immigration-related enforcement.
It is important to know that ICE or other local, state or federal agencies could be on campus for other reasons not related to immigration enforcement such as a presentation in a law enforcement class. These agencies still must follow the same guidelines during this time on campus.
EMPLOYEE NOTIFICATION TO DACC PERSONNEL
Employees shall notify one of the following DACC Administrators if any immigration-enforcement activity is taking place on any DACC campus properties:

These employees or their designees are responsible for handling DACC’s response to all immigration enforcement activities on campus.
If employees become aware or are contacted by any immigration-enforcement officer they shall do the following:
- Do not disclose any personal information of any students, employees, or visitors
- Direct officers to one of the above personnel
- Do not interfere if officers go into non-public areas
Employees, students, or visitors should not risk their safety or well being by interfering with any immigration enforcement.
CAMPUS WIDE NOTIFICATION PROCESS
The above listed campus personnel will determine whether or not a campus wide notification should be sent via DACC’s Rave notification system. DACC personnel may also consult with legal counsel in determining any course of action.
Any notifications sent will be based on facts and not contain any personal information.
HB 1312 does require DACC to maintain a campus wide notification protocol. However, not all immigration-enforcement activity requires a campus wide notification.
DACC is required to issue campus wide notifications regarding immigration-enforcement activity only when these actions create, or are expected to create, a disruption to normal activities.
These activities for notification may include:
- Interference with instructional activities
- Restricting access to campus facilities, programs, or services
- Creating a safety concern requiring campus security involvement
- Interference with DACC’s normal operations
The presence of immigration-enforcement officers on campus in public spaces does not necessarily require a notification.
The following activities may not require notification:
- A warrant, subpoena, or other legal process is presented for review
- Requesting access to a non-public location on campus
- Requesting assistance in locating or contacting and individual
These actions may be routine procedural matters and do not necessarily cause a disruption in normal campus operations.
VERIFY LEGAL AUTHORITY
DACC personnel must:
- Request information from law enforcement officers and or immigration-enforcement officials including names, badge numbers, identifications, contact information and purpose for being on campus.
- Request to review any warrant or court order.
- DACC Administrators may consult with legal counsel.
- Determine if it is a valid warrant authorizing the requested action.
- Grant or deny access based on the legality of the warrant.
- If officers do not present a valid judicial warrant, DACC personnel may verbally restrict access to non-public college areas. All college employees should not physically interfere with officers under any circumstances.
RECORDING ENCOUNTERS WITH IMMIGRATION ENFORCEMENT
- Following any encounter with immigration-enforcement officers, the Chief of Campus Safety will maintain an official record of the encounter on the Immigration Enforcement Post-Encounter Record.
- DACC will use these records to report to the Illinois Community College Board or appropriate state agency annually as required by law.
